In order to protect your rights, officers must follow proper procedure when pulling over a driver suspected of driving under the influence. If the officer lacks probable cause when making a traffic stop, any evidence obtained during the search could be suppressed in court. Arrests must also follow the correct protocol—if there was not enough evidence to make a DUI/OWI arrest, the entire case may be dismissed. Your chemical test may also be scrutinized. In Michigan, drivers over the age of 21 may be charged with drunk driving if their blood alcohol content (BAC) is .08% or higher. To determine your BAC, the officer may ask you to submit to a breath, blood, or urine test, with the breath test being the most common. Thanks to his training on the DataMaster—the breath test machine used by Michigan law enforcement agencies—Mr. Barone understands the known issues with the test.
